Privacy Policy

Effective Date: September 10, 2023

Acutech Technologies and our affiliates and subsidiaries, including, but not limited to, Acutech Technologies (“Acutech” “we,” “us,” or “our”) is committed to protecting your privacy.  This Privacy Policy describes how we collect, use, disclose and otherwise process the information we collect about you.  

For the purposes of the EU General Data Protection Regulation (“GDPR”), Acutech Technologies is a Data Processor with respect to the Personal Information (e.g., patients’ data) that Acutech processes on behalf of its customers through our products and services.  We are not responsible for the data privacy practices of our customers, which may differ from ours.  If you have any questions about our customers’ data privacy practices, please contact them directly. 

Acutech is a Data Controller with respect to the Personal Information of: (1) individuals who visit, use, or interact with the Sites; and (2) business contacts who represent Acutech’s current and prospective customers, vendors, and partners (collectively, “GDPR Data Subjects”).   From time to time, we will supplement this Privacy Policy with additional information about our privacy practices related to a particular activity Acutech undertakes. 

When We Collect Information 

We may collect the following information about you when you: 

  • Visit our main website (https://Acutech.com/), its subdomains, and all other websites that Acutech owns or controls and link to this Privacy Policy (collectively, the “Sites”); 
  • Contact us by submitting an online form on the Sites; 
  • Communicate with us by email, telephone, mail, or facsimile; 
  • Sign up to receive email, mail, or other communications from us; 
  • Apply for a job at Acutech; 
  • Otherwise, interact with Acutech and we refer you to this Privacy Policy. 

What Information We Collect  

We may collect the following information about you (collectively, “Personal Information”):

  • Contact information, such as your name; your place of business; job title; postal address; email address; phone number, and any personal or business contact information you voluntarily provide to Acutech;
  • Financial information, such as your credit card information, bank account details, and other payment processing information;
  • Job application information, such as your resume; curriculum vitae; employment history; educational history; references; qualifications; and any demographic information you share with us, such as your age/date of birth, race, ethnicity, sex, sexual orientation, and marital status;
  • Comments, questions, and complaints that you submit to us regarding our products, services, or the Sites;
  • Site usage information, including information we automatically receive about the devices you use to access the Sites, your IP address, the type of Internet browser used to visit the Sites, the areas of the Sites you visited and the actions you performed on the Sites, and information we collect using cookies and other tracking technologies; and
  • Other information you choose to provide, such as when you participate in a survey, promotion, request customer support, or otherwise communicate with Acutech.

Legal Basis for Processing 

We at Acutech process personal data if we have a lawful basis. Our lawful basis is as follows: 

  • Consent: We process your data only if you have given your consent freely for the same.  Where you have consented to a particular processing, you have a right to withdraw the consent at any time. You may withdraw consent by contacting us with a request using the details set out in the “Contact Information” section below. 
  • Contractual necessity: We process your personal data only when it is necessary for the performance of a contract. For example, if the processing is necessary in order to fulfill our commitments under the applicable terms of service. 
  • Legal Obligation: We process your data only if the use of your information is necessary for compliance with a legal obligation. 
  • Legitimate Interest: We process your data on the grounds of legitimate interest for example to provide our services, to occasionally send marketing information like updates on products and services, and to monitor the performance of the products/services.

How We Share the Information We Collect

We may share your Personal Information with the following parties:

  • Our corporate affiliates and associates (g., parent company, subsidiaries, or other companies under common control); 
  • Third-party service providers that support Acutech’ administration, provision, and marketing of its products, services, and the Sites; 
  • Third parties as requested, directed, or consented to by you; and 
  • To a company that acquires, or plans to acquire, our company, business, or our assets. 
  • Our employees, who need to know in order to help us provide our services or to process the information on our behalf. 
  • To provide such information in response to a court order or other applicable laws or legal processes.  
  • Relevant tax, payments, and customs authorities, who may pass this on to tax authorities in other jurisdictions. 
  • To prevent or respond to fraud, defend our websites against attacks, or protect the property and safety of Acutech and users, or the public. 
  • To comply with law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence. 

Cookies and Other Technologies

We may use cookies, tracking pixels/web beacons and or other technologies to receive and store certain types of information about your use of the Sites. “Cookies” are pieces of information that may be placed on your computer, tablet, or device for the purpose of facilitating and enhancing your communication and interaction with the Sites.

If we use cookies or other tracking technologies, they may fall within the following categories:

  • Category 1: Strictly necessary. These cookies and other technologies are strictly necessary to enable you to use the Sites. 
  • Category 2: User choices. These cookies and other technologies allow us to remember the choices you have made with respect to the Sites and to track your user preferences. 
  • Category 3: Marketing Cookies. We may use cookies storage required to create user profiles to send advertising, or to track the user on a website or across several websites for similar marketing purposes. 
  • Category 4: Third-Party Cookies. These cookies and other technologies are placed by our third-party partners for web analytics or advertising purposes. 

These technologies help us better understand user behavior, tell us which parts of our Product people have visited, and facilitate and measure the effectiveness of advertisements and web searches. To the extent that Internet Protocol (IP) addresses or similar identifiers are considered Personal Information by local law, we also treat these identifiers as Personal Information. Similarly, to the extent that non-Personal Information is combined with Personal Information, we treat the combined information as Personal Information for the purposes of this Privacy Policy. 

We also use cookies and other technologies to remember Personal Information when you use our Product, online services, and applications. Our goal in these cases is to make your experience more convenient and personal. For example, knowing your first name lets us welcome you the next time you visit our site. 

Generally, you may stop or restrict the placement of any cookies on your computer by adjusting your web browser preferences, but please note that this may impact your ability to use the Sites.

Our Policy Towards Children 

Our Services are not directed to children under 16. If you are under the age of 16, you are not permitted to use the Sites and Services or to disclose Personal data. We do not knowingly collect personal information from children under 16. If we learn that we have collected the personal information of a child under 16 unknowingly, please contact us using the details in the ‘Contact information’ section of this notice to ask us to delete the personal data.   

International Data Transfers

We are committed to complying with this Privacy Policy and data protection laws, including those outside of the United States, that apply to our collection and use of your Personal Information. We are primarily located in the United States, and we recognize that the laws in the United States may be different and, in some cases, not as protective as the laws in other countries, including those located in the European Economic Area (“EEA”). By providing us with your Personal Information and using our Sites, you acknowledge that your Personal Information may be transferred and processed in the United States.

Security of Personal Information 

The security of your information is important to us. We have implemented reasonable technical, physical and administrative security measures intended to protect your Personal Information from unauthorized access, disclosure, alteration or destruction.  Our Sites and Services use commercial efforts to maintain safeguards for the protection of your Personal Information. 

Examples of security measures include physical access controls, HTTPS, restricted access to data, monitoring for threats and vulnerabilities, etc. 

Please keep in mind, however, that no data transmitted over the Internet is 100% secure and any information disclosed online can potentially be collected and used by persons other than the intended recipient.  Accordingly, we cannot guarantee or warrant the security of any information you transmit using the Site. 

Retention of Personal Information 

We keep your Personal Information for as long as needed to fulfill the particular purpose for which it was collected. We may also retain your records if legally required or to fulfill our legitimate interests, including, but not limited to, defending Acutech against a legal claim. We take reasonable steps to delete or permanently de-identify your Personal Data that is no longer needed. 

Right to Opt Out of Marketing

To opt-out of receiving marketing from us, please click the unsubscribe link at the bottom of a marketing email or let us know by reaching us at the contact information below.  Please note that even if we stop all marketing communications, you may still receive administrative, legal, and other important communications from us.

Your Rights based on Jurisdiction 

For EEA (“European Economic Area”) Users: 

If you are a GDPR Data Subject, you have the following rights: 

  • Access.  You have the right to get a clear and understandable confirmation of what Personal Information we process about you. You also have the right to access this Personal Information as well as information on how we process it. 
  • Rectification.  You are entitled to have incorrect Personal Information concerning you rectified upon your request. Considering the purpose of the processing, you may also, in some cases, be entitled to supplement incomplete Personal Information. 
  • Deletion.  In certain cases, you may request that we delete your Personal Information (such as if your Personal Information is no longer necessary to meet the purpose for which it was collected, if you have objected to the processing of Personal Information and we do not have a legitimate interest which is more important your interest, if the Personal Information has been processed illegally, or if the Personal Information must be deleted to comply with a legal obligation). 
  • Restriction.  In certain cases, you may request that we restrict the processing of your Personal Information (such as when we are confirming the accuracy of your Personal Information, if the processing is illegal, if we no longer need your Personal Information but you need it to determine, enforce or defend legal claims, or if we are assessing whether we may lawfully process your Personal Information pursuant to our legitimate interests). 
  • Objection.  You have the right to object to the processing of your Personal Information that is based on our legitimate interest. In certain circumstances, you also have the right to withdraw your consent for processing if we are processing your Personal Information pursuant to your consent. 
  • Portability.  In certain cases, you are entitled to obtain the Personal Information you have provided to us in electronic format. You may also request that we transfer such Personal Information to another data controller.

If you wish to exercise your rights listed above, please contact us using the information in the “Contact Acutech” section below. We will respond to your written request without unreasonable delay and in accordance with any deadlines imposed by law. Unless we notify you at the time of your request, we will not charge you any fee in connection with the exercise of your rights. 

For California Users:  

California residents have a legal right to request organizations to tell them how their Personal Information has been shared, if at all, with third parties for the third parties’ direct marketing purposes. To make such a request, please reach us at the contact information listed below. This request may be made no more than once per calendar year, and we reserve our right not to respond to requests submitted other than to the email or mailing addresses specified below. 

Do Not Track

Certain web browsers and other devices you may use to access the Sites may permit you to submit your preference that you do not wish to be “tracked” online. We do not currently commit to responding to “do not track” requests, in part, because no common industry standard for “do not track” has been adopted by industry groups, technology companies, or regulators. We will make efforts to monitor developments around Do Not Track browser technology and the implementation of a standard.

The Sites may contain links to websites not affiliated with Acutech.  Your use of an external website or any informational content found on an external website is subject to and governed by the privacy policies, terms, and conditions of that website.  Further, we are not responsible for the privacy practices of any external websites.

Changes to the Privacy Policy 

We may modify or update this Privacy Policy from time to time. If we make any revisions that materially change the ways in which we process your Personal Information, we will notify you of these changes before applying them to that Personal Information.
